1. Acceptance of Terms
By accessing or using Hatilda Marketplace ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Platform. We may update these terms at any time, and continued use of the Platform constitutes acceptance of the revised terms.
2. Account Registration
To make purchases or sell items on Hatilda, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and current information during registration and keep your account details up to date.
3. Products and Listings
Hatilda Marketplace offers both new merchandise and pre-loved (second-hand) items. Product descriptions, images, and condition reports are provided as accurately as possible. Pre-loved items include a condition report detailing any wear, defects, or imperfections. While we strive for accuracy, slight variations may occur.
4. Pricing and Payment
All prices on Hatilda are displayed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change prices at any time. Payment must be made at the time of purchase. Accepted payment methods will be displayed at checkout.
5. Shipping and Delivery
We ship to addresses within Australia. Standard shipping typically takes 3–7 business days, while express shipping takes 1–3 business days. Free standard shipping is available on orders over $100 AUD. Shipping times are estimates and not guaranteed. Risk of loss transfers to you upon delivery to the carrier.
6. Returns and Refunds
We offer a 30-day return policy from the date of delivery. Items must be returned in their original condition. New items must have tags attached. Pre-loved items may be returned if they differ materially from the condition described. Return shipping costs are the responsibility of the buyer unless the item was misrepresented. Refunds are processed within 5–10 business days of receiving the returned item.
7. Intellectual Property
All content on the Platform, including text, graphics, logos, images, and software, is the property of Hatilda Marketplace or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, or modify any content without prior written consent.
8. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, Hatilda Marketplace shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
